The Murcia Judge Fernando Ferrín will be fined or removed from office
The General Council for Judicial Power, CGPJ, the body which oversees the judiciary in Spain, has confirmed that it is to take disciplinary action against the judge who wanted to separate a mother from her daughters because she is lesbian.
The Disciplinary Commission of the CGPJ was unanimous in the decision considering it a serious fault by the judge, Fernando Ferrín.
It follows earlier criticism of the judge by the Minister for Justice, Mariano Fernández Bermejo, who said that he had included unconstitutional concepts in his ruling.
The Murcia judge now faces the possibility of a fine, or even action could be taken against him to have him removed from duty.
He had ruled that the custody of two daughters be taken away from the mother following a divorce case, because the woman’s new partner was a woman. He called on her to chose between her daughters and her partner.
Other controversial decisions made by the judge will be looked at by the CGJP in September.
Judge Ferrín is already being investigated by the Murcia Supreme Court of Justice after allegations that he delayed the adoption procedure to a lesbian woman.
