Alicante lawyer asks for his client to be made drunk in drink driving charge

A request for forensic testing from a lawyer whose client is up in court for drink driving later this month has been turned down by the judge as ‘impertinent.’

The lawyer had asked the court for his client to be made drunk, to prove that he is capable of driving while under the influence of alcohol.

The suspect, who appears before criminal court No. 6 in Alicante on 30th October, was arrested last month after he was caught speeding through the city centre, and when tested for alcohol was found to be more than double the legal limit of 0.25 mg. The Información newspaper says he registered 0.57.

The judge said the variable factors present at the time, such as the amount of food he had eaten and his state of wakefulness, could not be repeated in a test.
