Application for asylum is one avenue to avoid returning to Algeria for possible prosecution as a homosexual
The Algerian transsexual who was due to be deported as an illegal immigrant by order of an Alicante court has now been released from the Valencia internment centre where she was being held. Europa Press said the deportation order was revoked by central government offices in Alicante, and M.B. has returned to the home she shares with her partner in Alicante following her release last Thursday night.
Her lawyer argued that she faced persecution in her home country if she was forced to return to Algeria, where she could have faced prosecution as a homosexual.
It’s understood she must now either apply for asylum in Spain or apply as any other immigrant would for permission to stay in the country.
