Málaga man found guilty in death of teenager killed by his stepdaughter

A gun he kept in the house accidentally went off when the two girls were playing with it

A criminal court in Málaga has found a man named as D.S.G. guilty of negligent homicide for the death of a teenager who was fatally shot in October 2002 when her friend, the accused’s step-daughter, was playing with a gun she had found in the house. It was amongst a number of weapons the accused kept in his girlfriend’s home, and he has also been found guilty of illegal possession of weapons.

The judge said in the ruling that while the gun which killed the friend was not loaded, the gun was in the teenager’s bedroom at the time of the fatal accident with the bullets on a shelf nearby, and found the accused guilty of serious negligence in failing to keep the weapons and ammunition away from the other occupants of the house.

The accused, who EFE reports is a security guard, has been banned from holding weapons for a period of four years, and his girlfriend was acquitted of charges.
