Owners of apartments in the hotel consider the Aifos company knew that the sale of the properties to them was illegal.

El País reports that at least three owners of apartments in the Guadalpin Hotel in Marbella, have started fresh legal action against the Aifos company for selling the rooms as if they where private dwellings, in the full knowledge, even before the construction of the hotel, that the procedure was illegal.

Aifos says that the properties were sold as hotel suites at all times, and not as homes.

Meanwhile Instruction Court 11 in Málaga has this week found the President of the Aifos construction group, Jenaro Briales, not guilty of fraud on a lack of evidence.
