The judge had no option when the prosecutor failed to appear.

El País reports that a 67 year old man who has been accused of abusing three young 13 year old girls in Mijas, was released by the court in Málaga because the prosecutor failed to appear before the duty judge. In that circumstance the judge could only issue a distancing order.

The accused lives in a house close to the victims, and has a stables in the area known as La Vega where the children were in the habit of playing. The children are reported to be very affected by what has happened and the family have decided to live elsewhere for a time.

The Andalucian High Court of Justice is now to investigate the case.
