email this article Diario Sur reoprts that eight out of ten people arrested in Málaga escape a prison sentence.Diario Sur reports this morning that eight of every ten people arrested by the police in Málaga since March this year, have been released by the courts. The paper says that only some 300 people of the 1,600 arrested over the time were sent to prison and that the situation is having a bad effect on police morale.
One long term policeman tells the paper that the criminals know the letter of the law, and know, for example, that if they steal items worth less than 400 € a time, they cannot be sent to prison.
Phone taps have revealed that the International criminals also know the details of the Spanish penal system, while local magistrates say all they can do is follow the law.
Police unions consider that the Penal Code is too generous with the criminal in certain crimes, and also think there is a lack of coordination in the judiciary, and they also note that prisons are already over capacity. Alhaurín de la Torre jail currently holds 2,000 people, triple its official capacity.
