email this article New DNA evidence shows that Rafael Ricardi did not commit the crime. The Prosecutors’ Office in Cádiz has announced that it has started procedures for the release of Rafael Ricardi, a man who has served 13 years in prison for a rape which it’s now known, thanks to new DNA evidence, that he did not commit.
Chief Prosecutor, Ángeles Ayuso, said that the police had lost their way a great deal in the case and said that a new report from the INT National Toxicology Institute had ruled out the participation of Ricardi in the crime.
The original sentence was based on Ricardi being identified by the victim and on the statements made by a National Policeman.
Last April police arrested another person for another crime, and saw that his DNA was a match in the Ricardi case.
Ricardi's release will now come thanks to the new criminal database law in Spain.
