email this article The man known as The Egyptian remains not guilty in the case.The Supreme Court has ruled that the man known as The Egyptian, who was released without charge in the Madrid Train Bombings trail, was released correctly, and has dismissed a prosecution request for him to be given a prison sentence for alleged terrorist activity. The man, whose real name is Rabei Osman El Sayed, is currently serving eight years on terrorist charges in Italy, and following the not guilty verdict in the Supreme Court here his lawyer in Italy has said they will demand a new hearing there.
Perhaps more surprisingly the Supreme Court also overturned three other prison sentences which had had been handed down in the original trial, and ordered the release of Abdelilah El Fadual El Akil, Basel Ghalyoun and Mohamed Almallah Dabas. They were condemned to nine years on a charge of collaborating with terrorists, or 12 years for belonging to a terrorist organisation, and all three left prison yesterday afternoon.
The Supreme Court also found a Spaniard, Raúl González Peña 'El Rulo', not guilty of supplying explosives, for which he had been sent to prison for five years in the National Court trial. The Supreme Court considered that there simply was not enough evidence against him to convict.
It means the number of people found guilty for involvement in the Madrid Train Bombings has been reduced from 21 to 18, and the Supreme sentence also underlines that there was no evidence of any ETA involvement, as had been part of a conspiracy theory at the time.
