Marbella judge De Urquía in court in Granada today

Proceedings in the court were postponed yesterday when the prosecutor withdrew on the request of the defence.

Judge Francisco Javier Urquía, the ex Municipal real estate assessor in Marbella, Juan Antonio Roca, and a third person charged, Arnauld F.A. will be declaring in court in Granada today in a case which is being treated independently from the Malaya case in Marbella.

Planned declarations yesterday were postponed following the withdrawal of the prosecutor, Jesús García Calderón, after the defence asked him not to proceed claiming that he lacked impartiality in the case. Phone calls between the prosecutor in another case against Urquía were alleged which the defence claimed affected their strategy.

The prosecutor is asking for three years in prison, a 19 year ban from holding public office and a fine of 213,000 € for the judge who faces charges of perversion of the course of justice, bribery, illegal negotiation with a civil servant and other charges.

Roca and Arnaud face the same prison term, a nine year ban from public office and fines of 177,000 € each in the case which continues tomorrow Wednesday with the appearance of 20 witnesses and when some taped phone conversations will also be heard by the court as the case continues.
