Eight years prison for Granada builder José Ávila Rojas

The Provincial Court in Granada has sentenced the Granada builder, José Avila Rojas, to prison for eight years and ordered him to pay a fine of ten million € for tax fraud. He was found guilty on four counts, each carrying a two year penalty.
The court considered it proved that he carried out the fraud ‘deliberately and consciously’ with the purchase and sale of two fincas in Marbella, manipulating his income tax and VAT declarations to carry out the fraud calculated by the authorities to amount to 3.5 million €.
The builder repeated his innocence to the court, saying he had never intended to falsely obtain anything, public or private and has now announced an appeal against the sentence.
Meanwhile in other Marbella cases, Rafael del Pozo, the local police chief who has been implicated in the Malaya case has been told by the TSJA, Andalucian High Court of Justice, that he has to leave his post. He had claimed that his position in the traffic department meant no conflict of interests with the ongoing Malaya case.
Ex Municipal Real Estate Assessor in Marbella, Juan Antonio Roca, was in court in Marbella yesterday with Ex Mayor Julián Muñoz. The two men told the judge that they had nothing to do with the deal established in the Town Hall to pass land to the Murcia businessman, Tomás Olivo, for the site of the La Cañada shopping centre for the modest sum of 44 million €. There were claims at the time that Olivo had done some work for the Town Hall and hence the cheaper price on the deal, but the prosecutor has found no evidence of that. The case is just one of 27 open against Julián Muñoz by the Anti-Corruption Prosecutor linked to real estate irregularities in the town.
And in Estepona, the ex Mayor, Antonio Barrientos, has been told that he must stay on remand, held in the Astapa corruption case. The Málaga Provincial Court has rejected a defence appeal for bail, saying they think Barrientos remains a flight risk and could also alter evidence in the ongoing investigation.
