The judge had reached the same conclusion himself last week.

The Penal Hall of the National Court has decided what the National Court judge, Baltasar Garzón, had finally decided last week for himself, that he is not competent to carry out the investigation into the crimes committed during the Civil War.

Garzón has already passed on the responsibility for the investigations to the courts in the locations of the mass graves, although it remains unclear whether the local courts will proceed.

The 18 judges who make up the Penal Hall of the National Court gave their ruling after the Chief Prosecutor of the court, Javier Zaragoza, challenged the competence of Garzón.
