Family win 45,000 Euro for their noisy second home

The family have suffered noise from a pub from the past 15 years in Pulpí, Almería

A family which lives in Pulpí in Almería province have been awarded 45,000 € compensation in the Andalucía High Court of Justice after suffering 15 years of noise from a pub. The court said the amount would have been far higher were not the home concerned a second residence.

The venue played music at more than 50 decibels volume and also failed to meet closing time legislation.
The establishment opened with a licence for a merendero beach bar, but Europa Press reports was in fact a pub with music open for 22 hours of the day.

A report from the local police however had said that the noise was ‘prudent and an agreeable atmosphere of quiet music’.

However the court considered it proved that the Pulpí Town Hall never once measured the noise being supported by local residents, and ordered it to pay the compensation to the family in the San Juan de Los Terreros area of the municipality.
