The future of the 22 floor structure is still unclear
It’s four years today since construction stopped on the Azata del Sol Hotel at El Algarrobico in Carboneras, Almería. On Feb 22 2006 a judge in Almería called for the provisional halt in the construction of the 22 floor, 411 room structure in the Cabo de Gata-Níjar Nature Park.
The municipal licence given to construct the hotel was then annulled in September 2008 by the Andalucía High Court of Justice, and appeals against that decision from both the local Town Hall and the promoter are still outstanding.
In fact that are more than 13 different legal processes open in a case which highlights the lack of coordination and clarity in the Spanish local, regional and national legislation when it comes to building along the coasts of Spain.
Ecologist groups, led by Greenpeace, Ecologistas en Acción and Salvamos Mojácar, meanwhile continue to demand the demolition of the structure, while an interdepartmental commission of the Junta de Andalucía has said that the hotel should be legalised along with a block of 250 residential homes contemplated in the plan parcial for the land.
