José Alberto Armijo had been charged with granting an illegal licence in a protected area of Maro
The Andalucian High Supreme Court of Justice, TSJA, has archived the case against the PP Mayor of Nerja, José Alberto Armijo.
He had faced charges linked to the granting of a building licence for a two story building in a protected area of Maro, registered as being of cultural interest, but the upper court considered that there was no crime because ‘the illegality was not so absolute or fragrant so that it could be considered as an arbitrary lack of respect for the rule of law, and because the protection in place was of such low level that any penal charge would be disproportionate’.
