Spanish Justice Minister criticises judge who denied custody to lesbian woman

The Minister said it is not within a judge's remit to use sentencing to defend opinions which fall outside the principles of the Constitution
The Justice Minister, Mariano Fernández Bermejo, has criticised the Murcia judge who removed custody from a mother because she is a lesbian.
Judge Fernando Ferrin said the mother ‘will have to choose between her daughters and her new partner,’ saying in his ruling last month that the ‘homosexual environment is prejudicial to children, and notably increases the risk that they too become homosexual.’
Speaking on Tuesday, the Minister said the function of a judge is not to use sentencing to ‘defend opinions which fall outside the principles of the Constitution,’ adding that the justice system is investigating the case: it’s in the hands of the General Council for Judicial Power, the body which oversees the judiciary in Spain.
The judge is already under investigation by the Murcia High Court of Justice, after a complaint from a lesbian woman that he was delaying her adoption application of her partner’s daughter.

The minister is very mild in his words for someone who is completely
stupid. But in legal terms, where is the evidence that ever in history
someone became homosexual because of parents or whatever other influence?
Nice to make a hint towards religion, mister minister, but a judge that
rules on assumption and personal stupidity and apparent lack of any
knowledge or experience in the world, ehhrrmmm... is not doing his job
properly. And gives Spain a bad name, the article is already all over the
gay websites in the civilised world.
