The 21 year old had been released from court as the prosecutor was absent when he gave his declaration
The Barcelona Prosecutors Office has ordered that the man arrested for carrying out a racialist attack on the city’s metro be re-arrested.
21 year old Sergi Xavier Martín is pictured on the front pages of many Spanish papers today after being released from court, with charges still pending, because the duty prosecutor was not in court when he made his statement.
He was shown widely on Television last night dismissively saying that he was drunk and remembers nothing of the attack. But he is clearly shown in video recorded by security cameras on the train which show him kicking a Ecuadorian girl in the face.
It’s understood that now the prosecution want to keep the aggressor in prison on remand. It comes after both the Attorney General, and the Minister for Justice commented that the offence was ‘very serious’. If found guilty of a racialist attack, he faces more than two years in prison.

What is really stricking to me is the guy just sitting there while this
young girl is being attacked. HE BEARS EQUAL SHAME IN THIS ATTACK. He is
not a man. You can not call you self a man and beat on a girl half your
size. A girl no less. look at him sitting there a coward's coward.

Dreadful behavour. As the attack has now got a very high profile, hopefully
the bully will be put away for a long 'stretch'.
The coward's behavour was also unbelievable.

His excuse is that he was drunk. At first he denied the whole thing and
said it was all lies. How pathetic. Racism is alive and well in Spain.
Xenophobia reigns everywhere

I wonder if the drunk man would have acted the same way if it were an
intimidating male immigrant sitting accross from him?
Is it racist to think Spaniard men are cowardly from the actions of both the assailant and the bystander? I don't think it would have come to that here in Canada, as much as racism exists here...a bystander would have definitely intervened.
