The driver had claimed 20,000 euros for damage to his car but withdrew it on Wednesday
The parents of a teenage cyclist who died in La Rioja almost four years ago when he was hit by a car say the driver’s decision to withdraw his claim for damages against them is a ‘first victory’ and they will not give up their efforts for a criminal case into their son’s death to be opened. The car driver, Tomás Delgado Bartolomé, had made a claim for 20,000 € to cover the damage caused to his vehicle and the cost of hiring a car, but failed to turn up at the hearing in Haro on Wednesday.
His lawyer told the court that his client was withdrawing the claim, because of harassment and the treatment he had received in the media.
The accident was in August 2004 when 17 year old Eniatz Iriondo Trinidad was cycling back to a camp site in Castañeres where he was on holiday with his parents. Police said Tomás Delgado had been drinking, but was not over the limit, and was driving at almost twice the speed limit. Eniatz was reported to have been thrown 18 metres into the air with the force of the impact.
An administrative agreement was previously reached in the case, where both parties admitted there was guilt on both sides. The chief prosecutor at La Rioja High Court of Justice announced after the recent publicity, however, that he is taking a new look at the case, ‘for the smallest legal requirement’ to reopen it if there proves to be a reason. Juan Calparoso did note that the original Civil Guard report on the accident did not detect any crime having been committed.
Eniatz’s mother, Rosa Trinidad, said as she left the court in Haro on Wednesday that Delgado’s decision to withdraw the claim ‘shows that he knows he was not in the right,’ and mentioned ‘proof’ of irregularities in the driver’s statement after the accident.
