Another ex Marbella Mayor appears before Óscar Pérez in the final phase of instruction in the Malaya case

Julián Muñoz, the ex Mayor of Marbella who is serving time for planning crimes, appears in court on Monday in the final round of questioning by the Malaya judge, Óscar Pérez, before the corruption case is handed over to the provincial court in Málaga for trial. He arrives under escort from the provincial prison in Alhaurín de la Torre. His successor as Mayor, Marisol Yagüe, did so last week, and was formally notified of the charges against her, but refused to answer any questions. Her ex Deputy, Isabel García Marcos, and other former Marbella councillors were also called before the judge last week, along with the former local police chief, Rafael del Pozo, and the ex municipal secretary, Leopoldo Barrantes.

Julián Muñoz is one of six people who will be questioned by Judge Pérez this Monday. With him on Monday is the ex Partido Andalucista councillor, Pedro Pérez, and on Tuesday six businessmen will appear. Amongst them are two managers of the real estate developer, Aifos, followed by the company’s president and general director at the next date, which is set for Monday next week. Also that day, the businessmen Carlos Sánchez and Andrés Leitor will appear before the judge.

The process now underway is the final stage of the instruction phase of the Malaya case, where the judge informs each of the suspects of the charges against them and defence lawyers have their first chance to put questions and to request new evidence. After that, the judge will issue a ruling of his conclusions on the case summary, and the provincial court will call the suspects’ lawyers to present their written defence. It will, by that time, have been two years since the first arrests took place in Malaya, in a case which has seen two instruction judges, 86 people formally charged as suspects, and the dissolution of Marbella Town Hall. It was run by a Management Committee for more than a year, until the Partido Popular took the helm last June following the local elections which were held in May 2007.
