Driver found not guilty after being caught in a speed trap at 260kms/hour claims 300,000 € damages

Constantino García was finally found not guilty at the Provincial Court in Burgos a year ago
A driver who has finally been found not guilty of driving at 260 km/hour is now demanding 313,454 € from the state in damages caused to his reputation, with his photograph being published in the press, and for the three month period for which his driving licence was withdrawn.

The 42 year old had told the court that it was impossible for him to be travelling at 260km/hour as his car, an Audi A-8, had a speed limiter set at 250km/hour. Constantino García was finally found not guilty of dangerous driving at 260kms/hour on the A231 motorway between León and Burgos in a controversial sentence when the judge also considered that dispute the claimed speed, it had not been proven that he represented a danger to other drivers at the time, as required for him to be found guilty under article 381 of the penal code.
