Ex Gil Councillors in Marbella offered a deal by the Prosecutors Office

Under the deal those accused of town planning irregularities will have to admit their guilt and serve six months to a year in jail.
The Prosecutors’ Office has offered an agreement with the ex GIL party councillors in Marbella who are charged with corruption or some irregularity regarding town planning permissions in the town.

Under the agreement the ex Mayors will serve between six months and a year in prison and thereby avoid having to sit on the accused bench. This means that Marisol Yagüe and Julián Muñoz, for example, can avoid a sentence which would have been three times longer, if they accept a prison term of between six months and a year for each crime that they are charged, as well as a ten year ban on holding public office again.

El País quotes sources at the Prosecutors’ Office which have explained that under this conformity agreement ‘each procedure will have its sentence and it will not be possible to substitute or suspend the prison term with a fine’. Each of the accused will also have to present to arrange their deal because each one has a separate set of circumstances.

This deal only applies to those who are charged with granting building licences in Marbella which were outside the Urban Plan, and other associated irregularities such as bribery, mis-use of public funds and the illegal collection of monies, among others.

If the ex GIL councillors do not accept the deal they will have to face a court case which contemplates six months to two years prison for each charge of which they are accused.

The Prosecutors’ Office is reported to be moderately satisfied with the deal, given that those accused in the case will always be condemned, and that the measure will save a great deal of human and material resources as the more than 60 outstanding cases will not have to be held.

Now it is up to those accused to study the offer with their lawyers, given that by accepting the deal they are also admitting that they are guilty of carrying out planning irregularities in Marbella.
