Telma Ortiz had gone to court in search of an order prohibiting the top media in Spain of printing her photograph without her consent.
The request made by Telma Ortiz Rocasolano, sister of Letizia, the Princess of Asturias, who had gone to court in an effort to protect her privacy following the birth of her son, has been thrown out of court and she has been ordered to pay costs of some 42,000 €.
She had taken action against 57 news media and magazines in Spain to try and stop them photographing her without permission and talking and writing about her private life, but María Lourdes Pérez Padilla, First Instance Judge number 3 in Toledo, denied the request considering it a case lacking ‘judicial viability’, given that by being the Princess’ sister she already had a public projection.
The judge also rejected claims of ‘possible physical danger’.
The irony of the case is that photos of Telma Ortiz are now all over the papers and magazine covers.
