Judge Laura Alabau has consistently refused to carry out gay and lesbian marriages.
The Government is once again forcing the Dénia judge, Laura Alabau to carry out the wedding for two gay British men which she refused to do last March.
Judicial sources told the Información newspaper that the General Direction of the Registry has allowed the appeal presented to it by the Alicante Prosecutors’ Office against the Magistrate, and ruled that there is no legal impediment to stop the marriage being carried out.
Laura Alabau had claimed that she could not carry out the wedding as gay marriage does not exist in the United Kingdom.
She has already been fined for criticising an earlier resolution which obliged her to carry out gay marriages, and was the first magistrate in Spain to make an appeal to the Constitutional Court against homosexual marriage, after refusing to marry a couple of lesbians. That was thrown out on the basis that the judge was not competent to place the claim.
Another similar claim to the Constitutional Court presented by the opposition Partido Popular remains pending.

The judge should carry out what is the law even though it seems to be
clearly against her own principles which I agree with her on and can
sympathise with her for. It's not her fault that Spain is now such a
Liberal country that it makes it acceptable and normal for 2 so-called
"men" to sodomise each other is it? If they prefer a hairy arse to a
furry-ring, that's their problem?

Bob, you worry me (although i understand what you're pointing out, and the
comparisons are disgusting) What this goes to show (plus a whole load of
other articles on spanish judges) is the amount of conservative-minded
people working as judges in Spain: and they don't have to be of a certain
age! this woman is no older that 30-35 years! This is where the judicial
system breaks down: young people with no experience, but who think the old
values should come back. Scary!
Anyway, two men or two women can live toghether and raise a family they'll probably do it much better moraly and value-wise that most hetero families! i.e. most homosexuals are progress-friendly, which is what we all need to do: look to the future!
