The Málaga court reduced the sentence against the father taking into account that he was drunk at the time of the abuse.
The Provincial Court in Málaga has sent a man to prison for three years after finding him guilty of sexually abusing his own daughter when the child was in his custody.
The prosecutor had initially asked for an eight year sentence in the case, but finally the court decided on a reduced penalty taking into account that the abuse occurred when the man was drunk.
He also has to compensate his daughter, born in 1992, with 6,000 €.

Sorry, but being drunk is NO EXCUSE! He should have had the full sentence!

If it wasn't for me living here for 20 years, i would say: UNBELIEVABLE!
But then again, a few months ago a guy in Alicante got away with
drink-driving because his lawyer showed the court he was capable of
"driving under the influence": Hey, everyone, why don't we all go out and
get p*ssed, because then we can do what we want! And because we're drunk,
we won't be held responsible for our actions! (unless you're british, we
all know the police wait for us at the exit from the port/drinking
area/etc) The Spanish Judiacial system should be ashemed of thefarce they
call justice! ( Oh, wait, they already are!)

This is unbelievable, the guy has got away with destroying his daughters
life, she has a life sentance to deal with the psycological damage her own
blood has put upon her, and they say that they reduce the sentance because
he was under the influence of alcohol !!!! This is just opening the book
for all pedeophiles to do anything to young children. I hope someone does
what he has done to his daughter whilst he is serving the very short
sentance in jail.
