The accused's wife and daughter finally testified in the man's favour but the judge based his decision on medical records.
Penal Court Number Two in Jaén has ordered a man to prison for 27 months and fined 90 € despite the fact that he suffers from Alzheimer’s and there is no denuncia against him.
The man was found guilty of ill-treating both his wife and his daughter, despite the fact that both women finally withdrew the complaints made earlier against him, with the Magistrate saying that he preferred to base his decision on the medical evidence which he said showed aggression had taken place.
The father is said to have hit the daughter in the face on at least two occasions as well as slamming a door in her face.
The accused told the court that he had never fought with his wife.
