The tragedy happened in Girona, where the Duty Judge considers it was a tragic accident.

The duty Judge in Olot, Girona, has decided not to charge the parents of baby who died, after they mistakenly forgot the child in the boot of their car. The judge considers it was a tragic accident.

It was the father who mistakenly shut the 25 day old baby in the boot, only to find him unconscious later.

A police investigation by the Mossos d’Esquadra regional Catalan force has shown it was a series of tragic circumstances which led to the tragedy.

It was just after midnight last night that the father placed the baby’s basket in the boot of the car, not realising that his son was inside, and it was only after driving for an hour to their destination that the parents realised what had happened. They are also parents to twins, and had travelled in separate cars, with the father thinking the mother had the newly born child in her car.

The mind boggles- a baby of 25 days old, and they did not know what was going on!
