Judicial Secretary in Del Valle case suspended without pay for two years

The Secretary of Sevilla Judge Tirado has been found guilty of a serious negligence in not ensuring that Santiago del Valle was sent to prison.

The judicial secretary who was working in the Sevilla court of Judge Tirado at the time when Santiago del Valle should have been sent to prison by the court for the sexual abuse of his own five year old daughter, Juana Gálvez Muñoz, has been sentenced by the Ministry of Justice to two years without employment and without pay, after the court failed to ensure the sentence was carried out.

It was this oversight which allowed Del Valle to be on the street and to go on to allegedly kill the Huelva five year old Marí Luz Cortés in March this year.
The one good thing the secretary can take heart from is that it is established that there was no bad intention intended by her acts, and for that reason the maximum possible sanction of a three year suspension without pay was not enforced.

Judge Tirado’s secretary has been found guilty of a serious fault of negligence and unjustified delays in the carrying out of her duties.

The harshness of the decision is at odds with the punishment already served against Judge Tirado, who only has to pay a 1,500 € fine, although that decision has now been appealed against by the Prosecutors’ Office which considers it too lenient.
