Jaén court rules that being vulgar is not a crime

A Spanish man who used to lift the skirt of his wife in the street has been found not guilty of ill-treatment.

A man, named as Juan Manuel R.R. and described by his friends as ‘a joker’, has been found not guilty of ill-treatment of his ex-wife by a court in Jaén because the court considered being vulgar is not a penal crime.

The Jaén Penal Court found the man not guilty of the mistreatment of his ex wife despite the fact that he would often lift her skirt and drop her underwear in the street, agreeing with the defence claim that he was just ‘trying to be funny’.

The court heard that on some occasions the man took out his testicles, putting them on the table, and declaring his balls were in charge.

The woman told the court that she suffered hell living with the accused, and was constantly humiliated and ill-treated.
But the judge ruled that being basic, the lack of education, and the vulgar behaviour of the man did not constitute a crime and dismissed prosecution demands of a three year prison sentence and 18,000 € for the woman.
