Saqueo corruption case in Marbella, opens in the National Court

Meanwhile the court in Marbella has denied that the paintings impounded from Juan Antonio Roca in the Malaya case are fakes.
The so called ‘Saqueo’ case regarding the plundering of the assets of Marbella Town Hall during the time that Jesús Gil y Gil was Mayor, finally got underway in the National Court on Friday.
The town’s ex Municipal Real Estate Assessor, Juan Antonio Roca, is at the centre of the allegations, but he told the court that he should not be judged in the case as the Tribunal de Cuentas is also investigating the alleged accounting irregularities in the municipality, and the law prohibits someone being judged twice for the same thing.
However the prosecutor rejected that argument, saying responsibility for accounting was one thing, but what was being judged now was criminal action. The prosecutor is calling for ten years in prison for Roca, with others also accused of diverting 36 million € to private accounts by way of fictitious municipal companies and false facturas.
Also facing charges are Francisco Javier Herrera and Eduardo Gonzálvez, from the companies Planeamiento 2000, and Contratas 2000, Jose Luis Sierra the ex judicial assessor to Jesús Gil, Manuel Jorge Castel an accountant, and Purificaión Notario the widow of the manager of the Contratos 2000 company.
Defence lawyers claim a 20 day delay in the start of the case has still not been enough time for them to prepare their cases, but the case continues.
Meanwhile reports in the Diario Sur newspaper and repeated here, claiming that the artworks impounded from the homes of Juan Antonio Roca in the Malaya case are all fakes, has been denied by Instruction Court 5 in Marbella. A statement said that all the paintings impounded are authentic, and the value of them is to be re-assessed.
