Judge Garzón hands over the Historical Memory cases to the local courts

The National Court judge in Spain has now decided that he is not competent to hear the cases.
National Court Judge, Baltasar Garzón, has now declared himself not competent to hear the cases regarding the Historical Memory Law and the possible opening of the mass graves dating from the Spanish Civil War.
The judge now considers that the local courts in the areas where the graves are sited should have the power to make the decision.
However the Professional Magistrates Association has said that the local courts can declare themselves not competent to hear the case if they wish, if they think the matter does not deserve investigation.
Garzón has also decided not to proceed with a penal case against the dictator Francisco Franco and 44 top members of the administration whom he had considered charging with crimes against humanity, apparently because he has confirmed that all of them are deceased.
It comes just a month after the judge announced that he would be proceeding with the case, but Garzón says he still considers that there is unfinished legal business and the 1997 amnesty law should be repealed, as recommended by the Human Rights Committee of the United Nations, so that families can move ahead and identify their loved ones and give them a decent burial.
