An expert in administrative law from Sevilla University, Jesús Jordano, contracted by Mijas Ayuntamiento, has suggested that nearly all the illegally built properties in the municipality be declared legal. He said that an agreement should be signed to do so with the Junta de Andalucía and that problems would only be seen for those properties constructed on environmentally protected land. He estimated that to include some 300 properties.
The professor also suggested the Town Hall should concentrate its efforts on investigating who has made money from the illegal building, and a census should be created, as has been seen in the Valle de Almanzora in Almería.
Over the past year some 2,000 property owners in Mijas have been told their property is illegal and faces possible demolition, and the Town Hall has been fining people 10% of the value of the property if they have failed to demolish it.
The new report makes it clear that the matter will eventually escape the Ayuntamiento, as it is the Junta which has the last word on the PGOU Urban Plan.
