The judge wants to know which court is competent to investigate what he considers to be a crime against humanity
National Court judge, Baltasar Garzón, has asked the Supreme Court to rule on which court is competent to open the mass civil war grave thought to contain the bones of the Granada writer, Federico García Lorca.
Garzón removed himself from the Historical Memory cases last November, handing over the responsibility to local courts to investigate the disappearances during the civil war years, but he now has asked for a ruling from the Supreme Court after the Instruction Court 3 in Granada refused to accept the case. Garzón has said he considers them to be crimes against humanity.
The grave containing the famous poet is between Viznar and Alfacar, and while Lorca’s family have said they would like him to rest in peace they are willing to accept the grave being opened and DNA testing to be carried out, respecting the wishes of the other two families involved as the banderilleros Francisco Galadí and Joaquín Arcollas are believed to rest in the same place.
The Junta de Andalucía is meanwhile reported to be investigating whether the grave could be opened if treated as an archaeological site.
