Another setback for National Court judge Baltasar Garzón who has been informed that the Supreme Court will not accept him to use evidence he asked for to defend himself against the three charges of perversion of the course of justice he faces.
A month ago the judge asked for certain evidence to be taken into account ahead of any decision to suspend him, but the judge who is investigating Garzón’s investigation into people who went missing in the Franco years, Luciano Varela, has now denied the request.
He wanted it taken into account that three National Court judges thought that he was competent to carry out the investigation and that their declarations be heard.
He also wanted statements on his behalf from international judges who are expert in amnesty laws in such cases, including the prosecutor from the International Criminal Court, Carla del Ponte.
The Supreme Court has agreed with the right-wing union bringing the case, Manos Limpias, that such declarations are unnecessary. There are conflicting opinions from commentators as to what this latest decision in the Supreme Court actually means for the future career of Spain’s most famous judge.
