However the constructor still faces charges in the Malaya case

The judge in Penal Court 6 in Málaga has found the Granada builder, José Avila Rojas, not guilty of fraud.

The case against him opened on June 3 and alleged that he sold on garages despite them being embargoed by hacienda. But the court considered that it was not proven that he knew about the embargo as part of an outstanding three million € debt.

The denuncia which brought the case came from 59 property owners in Residencial San Marino, in San Pedro Alcántara, where they acquired the garages via a private contract between 1997 and 2001.

However Avila Rojas will be back on the accused bench in three months time as one of the accused in the Malaya corruption case.
