It has been decided at the last minute by Judge Javier González Fernández, that it will be professional judges and not a popular jury who will decide in the case of the disappearance of the Sevilla 17 year old, Marta del Castillo, who vanished on the night of January 24 2009.
The change will delay the hearing, but not by more than two months, and has already been harshly attacked by Marta’s father, Antonio del Castillo, who says he will appeal.
‘From the start we have been fighting for a jury’, adding that he did not understand why the judge has changed his mind at this stage. Saying that he did not doubt the professionalism of the judges, he noted that the hearing would still be held in 2011.
The judge believes that rape was the final intention of the confessed killer in the case, Miguel Carcaño, and that it should not be heard by a jury as last jurisprudence would take it to the Supreme Court.
Four adults face charges in the case, Miguel Carcaño, who faces rape and murder charges, and his older brother Francisco Javier Delgado, his girlfriend María García and Samuel Benítez, who are all charged with covering up the crime.
