It's the second firm town planning irregularity sentence against the ex Mayor of Marbella
The Provincial Court in Málaga has confirmed the second firm sentence against the ex Mayor of Marbella,
Julian Muñoz.
He was found guilty of town planning irregularities and sentenced to a year and eight months in prison, and banned from holding public office for 8 years in the case which related to the granting of a building licence in a green zone in 1999.
It relates to works granted to the
Proinsa company to build 150 homes, garages and shops on a piece of land next to the Marbella Congress Hall.
The court has dismissed an appeal against the sentence launched by Muñoz and also ratified the sentences against another six GIL councillors. They are
Rafael González Carrasco, Mario Jiménez, Manuel Calle Arcal, Juan Antonio Yagüe Reyes (brother of the ex Mayor
Marisol Yagüe),
MarÃa Luisa Alcalá Duarte and
Dolores Zurdo Padilla.
It’s the second firm sentence for town planning irregularities to be issued against Julian Muñoz, the first one being for the Banana Beach case for which he was sentenced to 6 months in prison.
It’s significant because when firm sentences sum more than 2 years, prison cannot be avoided. As it happens Julian Muñoz is already in prison, on remand in the Caso Malaya.
Meanwhile the Provincial Court has also rejected the appeal for e bail launched by five ex Marbella Councillors who are all being held in prison in the Malaya case.
It means that the following will remain in custody in the Alaurin jail -
José Luis Fernández Garrosa, Vicente Manciles Higuero, Rafael Calleja Villacampa and
Rafael González Carrasco, all from the Grupo Independiente Liberal (GIL), and also
MarÃa José Lanzat Pozo, who has now been suspended from her party, the Partido Andalucista (PA).
