The judge in Burgos said the driver did not put anyone else in danger
The Provincial Court in Burgos has overturned a six month jail sentence and two year driving ban handed down by Penal Court 1 in the city, against a man,
Constantino GarcÃa Suárez, who had been driving down a local motorway at 260 kms/hour.
The judge in the provincial chamber considered that ‘dangerous driving’ charge did not apply. The judge admitted that the speed did reduce the driver’s reaction time and was an obvious danger, he had to take into account that there was no ‘concrete danger to anyone’. No one had to make an evasive manoeuvre, he said.
The driver was clocked in his Audi A-8 by a traffico radar trap doing 260kms/hour on a straight section of the A231 motorway between León and Burgos.
