Spanish Justice Minister criticises judge who denied custody to lesbian woman

The Justice Minister, Mariano Fernández Bermejo, has criticised the Murcia judge who removed custody from a mother because she is a lesbian.
Judge Fernando Ferrin said the mother ‘will have to choose between her daughters and her new partner,’ saying in his ruling last month that the ‘homosexual environment is prejudicial to children, and notably increases the risk that they too become homosexual.’
Speaking on Tuesday, the Minister said the function of a judge is not to use sentencing to ‘defend opinions which fall outside the principles of the Constitution,’ adding that the justice system is investigating the case: it’s in the hands of the General Council for Judicial Power, the body which oversees the judiciary in Spain.
The judge is already under investigation by the Murcia High Court of Justice, after a complaint from a lesbian woman that he was delaying her adoption application of her partner’s daughter.
