Landmark decision on maintainance payments

The provincial court in Barcelona has issued a landmark decision, with a ruling this week that a separated husband should be relieved of maintenance payments to his ex wife because she is now seen to be part of a stable relationship.

It is the first time that the concept of marriage has been given an equal footing with a relationship seen as stable, when the couple in question live apart.

It confirms an earlier ruling from a court in Granollers in 2005, and is the first resolution under regional legislation on stable common-law partnerships.
