A judge in Benidorm has ordered that a 29 year old local policeman, named only with the initials F.S., who shot dead a man who had climbed into his flat in the town to prison.

It now seems that the 32 year old intruder from Madrid was drunk, and had climbed from the balcony of a rented flat where he was spending the weekend with friends.

His friends urged David Carvajal to stop climbing, but he continued, wearing only trunks and barefoot, until he arrived on the balcony of the neighbouring flat, owned by the local policeman. That was the last time his friends saw him alive.

The police are now trying to establish what happened and why the local policeman took an hour and a half to report the incident, and when he did, how he had been injured with a stab wound.
