Andalucian high court postpones Marbella demolitions

The Andalucian High Court of Justice, TSJA, has again ordered that the demolition of homes built in Marbella under a municipal licence granted by the Gil administration, not be demolished.

The ruling which saves 29 flats in the town considers that no demolition should take place until the new PGOU Urban plan is in place in the town. The court has thus responded to requests from both the Marbella Town Hall, and the regional government, The Junta de AndalucĂ­a, to postpone the decision to demolish the properties in the Rio Real area of Marbella.

The flats, blocks 6,7,8 and 9 in the Playa Golf Rio Real Urbanisation, are built on land which should have been kept free for leisure use, as it is directly on the coast.

It now remains to be seen whether somehow the properties can be brought into legality in the new PGOU.
